Terms of Service

These Terms govern your use of betaches.com. By using the site you agree to them. If you submit an entry, the Official Rules also apply, and where the two documents conflict on a Contest question, the Official Rules control.

1. What This Site Is

Bet Aches is an entertainment property. It collects stories about bets that went badly so they can be featured on a comedy program, and it pays one hundred dollars a week for the one that hurt the most.

2. What This Site Is Not

Bet Aches is not a sportsbook, a betting exchange, a tout service, or a financial service. We do not accept wagers. We do not hold your money. We never ask you to pay anything. Nothing on this site is betting advice, investment advice, or a prediction of any outcome. Money moves in one direction only: from us to a weekly winner.

If any page on this site ever asks you to send money, deposit funds, or provide a bank account, card number, or Social Security number, it is not us. Do not comply, and please report it to the contact address in the Privacy Policy.

3. Eligibility to Use the Site

You must be at least 21, or the legal age of majority where you live, whichever is greater, to submit an entry. You may browse public pages regardless, but the Contest is limited as described in the Official Rules.

4. Your Content

You keep ownership of what you submit. You grant us the license described in Section 6 of the Official Rules so the show can use it. You are responsible for having the rights to everything you upload, including permission from anyone who appears or is heard in it.

Do not submit content that is unlawful, defamatory, harassing, hateful, sexually explicit, that depicts a minor, that infringes anyone's rights, or that includes broadcast footage or commercially released music you do not have rights to. We may remove or refuse any submission for any reason.

5. Acceptable Use

You agree not to:

• Submit false, fabricated, or altered bet slips or accounts.
• Use bots, scripts, or automated tools to submit entries.
• Attempt to access the review console or any account, data, or system you are not authorized to access.
• Probe, scan, or test the vulnerability of the site, or interfere with its operation or availability.
• Scrape, harvest, or bulk-collect data or media from the site.
• Impersonate anyone, or misrepresent your affiliation with any person or entity.

6. Our Content

The Bet Aches name, logo, page design, copy, and code are owned by the Sponsor or its licensors and are protected by copyright and trademark law. You may not copy, adapt, or reuse them without written permission. Team names, league names, and other third-party marks that appear on this site belong to their respective owners and are used only to identify the subject of an entry. No affiliation, sponsorship, or endorsement by any league, team, or sportsbook is claimed or implied.

7. Availability

The site is provided as-is. We may change, suspend, or discontinue any part of it, including the Contest, at any time and without notice. We do not guarantee the site will be available, uninterrupted, or error-free, and we are not responsible for an entry that fails to reach us.

8. Disclaimer of Warranties

To the fullest extent permitted by law, the site and all content on it are provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, the Sponsor and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of your use of the site or your participation in the Contest. Our total aggregate liability to you for any claim relating to the site or the Contest will not exceed one hundred United States dollars (US $100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted.

10. Indemnification

You agree to indemnify and hold harmless the Sponsor and its affiliates from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of content you submitted, your breach of these Terms, or your violation of any law or the rights of a third party.

11. Third-Party Links

The site may link to sites we do not control. We are not responsible for their content, terms, or privacy practices. Following a link is at your own risk.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

13. Changes

We may revise these Terms. The "Last updated" date above reflects the current version. Continuing to use the site after a change means you accept the revised Terms.
